Question: A person intended to perform 'Umrah or Hajj, but he passed the miqat and entered the state of ihram before reaching it, and he completed the rituals of Hajj or 'Umrah. What is obligatory upon him?

Answer: He must slaughter a sacrificial animal (hady) and distribute it to the poor of the Haram, and he must not eat from it if he passed his miqat without being in the state of ihram and then entered the state of ihram afterwards while intending 'Umrah or Hajj when he passed the miqat. This is based on the saying of the Prophet (peace and blessings be upon him) when he designated the miqats for the people of Madinah, the Levant, Yemen, and Najd:
They are for them, and for whoever comes to them from among those who are not of their household, from among those who intend Hajj and 'Umrah. And whoever is from a place further away, his miqat is from where he begins, until the people of Makkah, whose miqat is from Makkah.هن لهن ولمن أتى عليهن من غير أهلهن ممن أراد الحج والعمرة، ومن كان دون ذلك فمهله من حيث أنشأ حتى أهل مكة من مكة
It is agreed upon that it is authentic. An exception to this is one who intends to perform 'Umrah from among the people of Makkah; it is obligatory for him to enter the state of ihram from the halal area (outside the sacred precinct), because the Prophet (peace and blessings be upon him) ordered 'A'ishah to do so when she intended to perform 'Umrah while she was in Makkah. And success is from Allah.
