And here is a point: The scholars (may Allah have mercy on them) differed in their opinions on this issue,Some of them said: there is no blame, but he owes blood money for missing the order, and this is a weak opinion;Because it contradicts the hadith: (there is no blame) and he did not order him to pay a ransom. Did the obligation of a ransom escape the Prophet (may Allah's prayer and peace be upon him)? By Allah, absolutely not. Or was it present to him but he concealed it? Far from it,Therefore: making blood money obligatory is the weakest of the opinions.
And some said: Advancing and delaying is permissible if it is due to ignorance or forgetfulness,Because some of the questioners said: I did not notice, so I did such and such before such and such. So restricting that to ignorance and forgetfulness is weak; because if it were not permissible in the general case, the Messenger (may Allah's prayer and peace be upon him) would have said: Do not repeat it, just as he said to Abu Bakrah (may Allah be pleased with him) when he hurried and bowed before reaching the row,He said to him: (May Allah increase your eagerness, and do not repeat it) and he did not say: there is no blame. So the important point is that not arranging the rites is permissible without blame, whether intentionally, out of ignorance, or out of forgetfulness,But the consideration remains as to which is better: The order or the lack of it? The order is undoubtedly better; because it is the action of the Messenger (may Allah's prayer and peace be upon him),And he said: (Take your rites from me) .
If someone were to say: If it is easier for me to advance the circumambulation before the stoning and shaving or shortening; because I have women with me and I fear that menstruation will come to them before the circumambulation of completion, so I am forced to stay in Makkah or go to my country and return when the woman becomes pure?We said: Now, it may be better for you to start with the circumambulation even if you go against the order,Due to the generality of the saying of Allah (Blessed and Exalted is He): [al-Hajj: 78] ,and His saying, the Exalted: [al-Baqarah: 185] .
