Ruling on stoning the pillars before the sun passes its zenith

Machine translationRead the Arabic original
Issue: If one stons the three pillars before the sun passes its zenith during the days of Tashreeq, or begins, even with a single pebble, before the sun passes its zenith, is that sufficient?
No.
It is not sufficient, neither on the eleventh day, nor on the twelfth day, nor on the thirteenth day; because the Prophet (peace and blessings be upon him) stoned after the sun passed its zenith and said: (Take from me your rituals) and because he would wait and anticipate the passing of the sun, and from the time it passed, he would stone before praying the midday prayer, which indicates his intense care to catch the time of the sun passing its zenith so he could hasten. If stoning before the sun passed its zenith had been permissible, the Prophet (peace and blessings be upon him and his family) would have done it, and he would have granted a dispensation for the weak, just as he granted a dispensation for stoning before the sun rises on the day of Eid;because if he advanced it before the sun passes its zenith, which of the two is easier: before the sun passes its zenith in the open space, or after the sun passes its zenith in the intense heat? Before the sun passes its zenith. And it was the custom of the Prophet (peace and blessings be upon him) that whenever he was given a choice between two things, he would choose the easier of them, as long as it was not a sin. If stoning before the sun passed its zenith had been permissible, he would have permitted it for the Ummah; because the Messenger (peace and blessings be upon him) is merciful and compassionate to the believers. Do not be deceived by one who issues a fatwa permitting stoning before the sun passes its zenith on the twelfth day, arguing that this is more comfortable for the people;because we say in the answer: I am not more merciful than Allah and His Messenger
to the believers is kind and merciful.بِالْمُؤْمِنِينَ رَءُوفٌ رَحِيمٌ
[At-Tawbah: 128] If this had been permissible, He would have permitted it.

If someone were to say: Did the Prophet (peace and blessings be upon him and his family) not witness this severe crowding, and this violence from some of the pilgrims, and this oppression? We said: But Allah knows that, and if stoning before the sun passed its zenith had been permissible, Allah (Mighty and Majestic) would have permitted it out of dire necessity, just as He permitted carrion out of dire necessity. So let no one be deceived by the fatwa of any of the predecessors or successors. (Guidance takes precedence over desire) Guidance takes precedence over the saying of everyone, and guidance is what came through the Book and the Sunnah.

If someone were to say: Will there be severe crowding if we delay the stoning on the twelfth day until after the sun passes its zenith? We said: Yes.
There will be severe crowding at the time the sun passes its zenith -Meaning: immediately after the sun passes its zenith - but at the end of the day it eases. Then, if it happens that the crowding persists until sunset, stone after sunset and walk; because you are in a hurry,And Allah Mighty and Majestic says:
Then whoever hastens [his departure] in two days - there is no sin upon himفَمَنْ تَعَجَّلَ فِي يَوْمَيْنِ فَلا إِثْمَ عَلَيْهِ
[Al-Baqarah: 203] But if you were unable to stone on the two days, then delaying the stoning, if it is not performing it in its proper time, is making it up out of dire necessity,So we say: there is no blame on you. You prepare and go, and if something holds you back, whether it is the crowding of cars or the crowding of people at the pillar, stone even after sunset, and continue your departure from Mina.
By this, we know that the issue is nothing but a matter of the actions of people, not based on the reality. It is the actions of people, which is that they crowd at the time the sun passes its zenith to disperse. But if they had been patient and seized the opportunity, this would not have happened. So the matter, praise be to Allah, is broad.
