How an agent handles the money of people

Machine translationRead the Arabic original
I have one-third shares of funds,Meaning: dirhams, which I intend to put into the car trade. I asked about the car: from the day I hand over the dirhams, I take the key and that is sufficient, or do we move it? Also, is there a clear limit to the profit, and does zakah become due on it at the end of the lunar year, or whenever I receive a portion of it?The Shaykh: Regarding these one-third shares you have, did they specify a particular thing to be put into, or is it up to your opinion? The questioner: Some of these people are still alive, and some have passed away leaving orphans. We gathered their money to grow it for them.
As for the living who bequeath it to Allah, the best we see for it now is to build mosques with it. If it can cover the full cost of building a mosque, that is the goal; if it cannot, then to participate in it;And that is for reasons: First: the mosque has reward day and night. People pray in it during the day, and they pray in it at night. Students of knowledge sit in it to discuss knowledge, and Quran circles also study in it and recite the Book of Allah.

Second: It provides comfort for a person in his life and after his death,As long as the person is alive, perhaps it means: He walks well in executing the one-third; but if he dies, this one-third may be destroyed, and no one will carry it out as required.

Third: The mosque is where the rites of Islam are performed,And the greatest pillar of Islam after the two testimonies is: The prayer performed in it, and the builder of the mosque receives from the reward of these praying people what they receive of reward. So it is better. For this reason, I advise every person who has money he wants to bequeath to spend it on building mosques. It is better for him and his descendants, and so that there is no dispute or the one-third is not wasted later.

As for the money of orphans: So do not put it in mosques. It is obligatory for the guardian to trade with it if that is better. If it is not better, let it remain, praise be to Allah, and let it remain until they eat it and it is exhausted, and Allah provides for whom He wills without reckoning.
And it may be in the interest that you participate in lands, for example, if the land has a future, and you participate and Allah brings the provision,You participate with a person, for example: Trust,You give him what is easy and you say: Oh so-and-so! Take this, sell it and buy, and the profit between us is halves or quarters or thirds. As for the issue of selling cars, I advise you not to enter into it. Do not betray your trust and cause others to consume something forbidden; because most of the sale of used cars now is forbidden. You find him buying a car and selling it in the same place, and buying a car and selling it, and buying a second car when he did not intend the car but intended the increase, and this is riba; but it is a trick. For this reason, mosques are before you now. I see that the one-third shares should be spent on building mosques and you will be at ease.

Second: As for the money of orphans, I see that you should handle it in a permissible way, and not approach what is forbidden,Because Allah says:
And do not approach the orphan's property except in a way that is bestوَلا تَقْرَبُوا مَالَ الْيَتِيمِ إِلَّا بِالَّتِي هِيَ أَحْسَنُ
[Al-An'am: 152] And it is not best to put them in a matter involving riba, causing them to consume illicit gain and harming them.
And I see that you should not approach it, my brother, because for example, I am a person who wants a car,Someone comes and says: This particular car,She says: Good! Buy it, and I will give the showroom the rest and lend it to you. This is a clear trick, like the sun.
Even if you inform him of the good, it remains that you must bring it to your house, and you must transfer it to your name, and they do not do this,Then some scholars say: This known debt is forbidden. They call it: the issue of tawarruq (a commodity sale used to obtain cash). Ibn Taymiyyah (may Allah have mercy on him), the famous Shaykh al-Islam, renowned for his knowledge, jurisprudence, and trustworthiness, sees it as forbidden.
