The third and final question in the letter of our brother Fakhri 'Abd al-Wahhab al-Ja'far is as follows: If a person performs Hajj on behalf of a Muslim, and the deceased's guardian gives him a sum of money, and a portion of the sum remains, is it permissible for him to dispose of it, given that the guardian has forgiven him the remainder, or must he return it? Please answer us, may Allah reward you, and may He reward you with all good for the Muslims.
Answer: Yes, if he gave him the money to perform Hajj with it and forgave him the remainder, there is no harm; he may dispose of it as he wishes, spending from it and using the rest for his needs. However, if he gave him money and said to him, "Spend from it on your needs and return the rest," then he should spend from it on his needs without extravagance or waste, and then return the rest.
As for if he gave him the money and said, "It is yours, whether anything remains of it or nothing remains of it, it is yours," and forgave him the remainder, then there is no need to return it; it is his money, and he may dispose of it once he has fulfilled the obligatory duty. Yes.
