There is a woman who paid the zakat on her gold, intending to give it to her husband. After she paid the zakat, the amount she had was what she gave to her husband, but she deducted a small portion from it, thinking that since the husband is obligated to provide her maintenance, this was part of the obligatory maintenance due from the husband. She had informed her husband that she intended to pay the zakat on the gold and give it to him.
It is not permissible.First: Some scholars say that it is not permissible for a woman to give her zakat to her husband under any circumstances, whether he is poor or in debt. The correct view is that it is permissible for her to give her zakat to her husband if he is in debt and wants to pay off his debt, or if he is poor. However, it is not permissible for her to deduct from it, before handing it over to him, an amount equivalent to her maintenance. She should give it to him, and he may dispose of it as he wishes.
