The questioner: Up to now, we have said that the things that break the fast have four conditions: that one be mindful, but do we generalize—for example—this to all the things that break the fast?The Shaykh: All the things that break the fast, all the prohibitions in every act of worship, these three conditions are necessary in them, even in the prayer, if a person speaks while forgetting or out of ignorance, not knowing that speech invalidates the prayer, even in the prohibitions of the state of ihram.

The questioner: In one party in this act of worship, but intercourse involves both parties.

The Shaykh: Yes.
And the two parties, is it not possible for them to forget?The important thing we say is: If forgetfulness occurs, as for whether it is possible or not? This is possible intellectually, without doubt. It is true that forgetfulness in eating and drinking is more common than in intercourse,But as long as we have the rule:
Our Lord, do not impose blame upon us if we have forgotten or erred.رَبَّنَا لا تُؤَاخِذْنَا إِنْ نَسِينَا أَوْ أَخْطَأْنَا
[al-Baqarah:286] so it encompasses everything.

The questioner: One of the Companions came to the Messenger of Allah (peace and blessings be upon him) and said: I have done a great matter and I am ruined,The Messenger of Allah (peace and blessings be upon him) did not ask him: Was he ignorant or forgetful?The Shaykh: It was said: The Messenger (peace and blessings be upon him) knew,He said: I am ruined.
And this indicates that it was intentional,And for this he said: (O Messenger of Allah! I forgot and I came to my wife) When he said: I am ruined.
He knew that it was intentional, but if a person did that—had intercourse—but did not know that an expiation was required of him, is he excused? He is not excused, if he knew that it was forbidden, he has violated the sanctity, so the expiation is obligatory upon him, even if he says: If I had known about this expiation, I would not have done it.

We say: This is not an excuse for you.
Like the one who commits zina, for example, if he commits zina while knowing that zina is forbidden, but he does not know that he will be stoned if he is a married man,And he said: If he had known he would be stoned, he would not have done it,We say: This is not an excuse for you.
