The questioner : A person asks: He had intercourse with his wife during the day in Ramadan without knowledge, meaning out of ignorance on their part. What is the ruling in that?

The Shaykh : Meaning, ignorant that intercourse is forbidden, or ignorant of what?

The questioner : Ignorant that it does not break the fast; that it is not among the things that break the fast.

The Shaykh : Meaning, he thinks it is permissible.

The questioner : That is, he thinks it is permissible.

The Shaykh : Then he owes nothing if he has intercourse with his wife during the day in Ramadan while thinking that intercourse is not a problem. There is no blame on him, no sin, and no expiation.
The Shaykh: Because the principle is "that whoever does a prohibited act in worship while forgetting or being ignorant owes nothing", due to the saying of Allah the Exalted:
Our Lord, do not impose blame upon us if we have forgotten or erred. رَبَّنَا لا تُؤَاخِذْنَا إِنْ نَسِينَا أَوْ أَخْطَأْنَا
[Al-Baqarah 2:286]
So Allah the Exalted said:
He has done so قد فعلت
And due to His saying the Exalted:
And there is no blame upon you for that in which you have erred but [only for] what your hearts intended وَلَيْسَ عَلَيْكُمْ جُنَاحٌ فِيمَا أَخْطَأْتُمْ بِهِ وَلَكِنْ مَا تَعَمَّدَتْ قُلُوبُكُمْ
[Al-Ahzab 33:5]
