Exegesis of His saying, the Exalted: (And those who practice zihar with their wives and then return from what they said)
Then Allah explained the ruling on zihar, the ruling that the scholars of usul al-fiqh (the principles of jurisprudence) call the conditional ruling, meaning: What do we do if zihar occurs? So Allah the Mighty and Majestic said: [Al-Mujadilah: 3-4] Now, how many items did Allah the Exalted mention?three times: Freeing a slave, fasting for two consecutive months, and feeding sixty poor people.
This is the expiation for zihar if a person returns from what he said, and the meaning of his return to what he said: that he returns to his wife whom he likened to the back of his mother by resolving to have intercourse with her,So we say: before he has intercourse, it is disbelief.
First: Freeing a slave, and the meaning of freeing is: releasing her from slavery,Meaning: if a person has a slave owned by him, he frees him, or he buys him from the market and frees him. If he does not find the price of the slave or the slave is not available, like in this era now, there are no slaves as far as we know.
That is: he must fast for two consecutive months, not breaking the fast in between except for a valid legal excuse. Are the two months sixty days, or are they two lunar months?
The second month,Meaning: Two lunar months. So if the first month is short and the second is short, the days will be fifty-eight days, and there is no harm; because Allah did not say sixty days,He said: (two consecutive months) and His saying: (consecutive) means: it is obligatory not to break the fast in between except for an excuse, such as travel or illness. If he does not make them consecutive by breaking the fast for a day during the two months without an excuse, he must start over; because Allah stipulated that the two months be consecutive, so he must start over.
[Al-Mujadila 58:3] That is: before one of them has intercourse with the other, he remains abstaining from his wife for a period of two months. This is if he starts fasting immediately. But if he delays, he might delay—for example—one month and then fast, so he remains away from his family for three months.
[That is: you are admonished by this from this forbidden, reprehensible statement.
So whoever cannot fast for two consecutive months, either due to illness or due to intense desire, meaning: due to desire for intercourse or the like[Al-Mujadila 58:4] That is: he must feed sixty poor people. Does he feed the sixty poor people before he has intercourse, or is it permissible for him to have intercourse before he feeds them?regarding the neck, he said:[Al-Mujadila 58:3] And regarding fasting, He said: [Al-Mujadila 58:3] So the apparent meaning of the noble verse is: it is permissible for him to return to his wife and have intercourse with her before he feeds them, but the scholars of knowledge say: that feeding, like the others, he does not return to his wife until he feeds them,And they said: If Allah the Exalted made it obligatory that the expiation be before intercourse in the case of freeing a slave, and this might be delayed, perhaps a person remains searching for a slave for a month or two or more, and in the case of fasting, which is two months, he remains not having intercourse with his wife until he fasts, what can be said about feeding? Feeding can be done within half an hour, is that not so?They say: So if freeing a slave and fasting must precede the return, then feeding is even more so. But how does he feed sixty poor people?Feeding them is done in two ways: The first method: that he prepares a lunch or dinner and invites sixty poor people. If the place does not accommodate sixty, he invites ten today and ten others tomorrow and ten others the day after until he completes sixty poor people, for lunch or dinner. If he does not prepare a lunch or dinner, let him feed each poor person a kilo of rice with meat,Meaning: he takes bags of (nylon) and puts in them a kilo of rice with meat, a little meat that is sufficient for him alone, and distributes it to sixty poor people, and thereby the expiation is completed.
But if a person cannot even feed them,So do we say: do not approach your wife until you are able to feed them, or fast, or free a slave? We say: Allah the Exalted said: [Al-Taghabun: 16] And on this basis, he may come to his wife and there is no blame on him.
[Al-Mujadila 58:4] That is: We made that obligatory so that your faith may be established, for whenever a person is obedient to the command of Allah despite hardship, his faith and his desire for what is with Allah increase.
[Al-Fath 48:9] Meaning: Muhammad (peace and blessings be upon him) [Al-Baqarah 2:104] He concluded the verses with this phrase,As if he is saying: Prepare for the painful punishment if you do not believe in Allah and His Messenger and fulfill what Allah has made obligatory upon you of the expiation.
Then Allah explained the ruling on zihar, the ruling that the scholars of usul al-fiqh (the principles of jurisprudence) call the conditional ruling, meaning: What do we do if zihar occurs? So Allah the Mighty and Majestic said:
(3) And those who pronounce thihar from their wives and then [wish to] go back on what they said - then [there must be] the freeing of a slave before they touch one another. That is what you are admonished thereby; and Allah is Acquainted with what you do. (4) And he who does not find [a slave] - then a fast for two months consecutively before they touch one another; and he who is unable - then the feeding of sixty poor persons.
