Are there any matters that follow the disbeliever in our practical lives other than the implementation of the hudud (fixed Qur'anic punishments)?

Machine translationRead the Arabic original
The questioner : If Allah wills. But is it true that there are no other matters that follow a person's disbelief except the hadd of execution?

The Shaykh : How?

The questioner : A person who has committed kufr (disbelief). We do not rule on a person. I mean, you are saying that we do not benefit if we rule that a person has committed kufr (disbelief) or...

The Shaykh : No problem... your words, yes.

The questioner : Unless there is an Islamic government that applies the hadd.

The Shaykh : Yes, yes.

The questioner : And are there no matters that follow the disbeliever in our practical lives other than the implementation of the hadd against him?

The Shaykh : Yes, but who wants to? Who wants to rule before the hadd is implemented, as we mentioned? And this is not our topic.

The questioner: Yes.

The Shaykh : Our topic now is who will rule that so-and-so has committed kufr (disbelief), God forbid. For example, a married man, the father of a Muslim girl.

The questioner: Yes.

The Shaykh : Ah, we need to say that he has committed kufr (disbelief) so that what? We take our daughter from him? That is correct. But who rules that he has committed kufr (disbelief)? Zayd, Bakr, and 'Amr, or the scholars of knowledge?

The questioner : The scholars of knowledge.

The Shaykh : Well, the scholars of knowledge are the ones who rule. We do not open the field for students of knowledge, regardless of their level, high or low, to issue rulings. This is the reality today, and I do not think it is hidden from you. They use the word of takfir (declaring someone a disbeliever) in Syria by the bushel, by the handful, in bulk, meaning...

The questioner: Yes.

The Shaykh : So this is a very great error. Therefore, the matter is dangerous, especially if we remember his saying (peace be upon him):
Whoever declares a Muslim to be a disbeliever, then disbelief has encompassed one of the two. مَن كفَّرَ مسلمًا فقد حار الكفر على أحدهما
And in a famous narration:
He has committed disbelief فقد كفر
if he was not... So let our function now be two things: first, seeking knowledge, and second, conveying knowledge, as he said (peace and blessings be upon him):
Convey from me, even if it be an Ayah, and narrate from the Children of Isra'il, and there is no harm, And whoever lies upon me purposely, then let him take his seat in the Fire. بلِّغوا عنِّي ولو آية ، وحدِّثوا عن بني إسرائيل ولا حرج ، ومَن كذبَ عليَّ متعمِّدًا فليتبوَّأ مقعدَه من النار
Jami` at-Tirmidhi 2669Sahih (Darussalam)
And I believe that if the students of knowledge today stopped themselves and dedicated their lives to studying the Sunnah and distinguishing its authentic from its weak, with the help of the scholars of the past, especially, that would suffice them in knowledge and occupy them with the disputes and conflicts currently existing between the Islamic groups. I think we have reached the end of the answer, if Allah wills.

The questioner : May Allah reward you with good.

The Shaykh : Anyone else? Please.
