A man brought in a worker, and when the worker arrived from his country, the guarantor said to him, "I do not have an establishment, but you can work on a percentage basis, or else you can leave." He agreed because he was in debt, and then he paid off his debts.

The questioner : May Allah reward the honorableThe Shaykh : I am a worker who came to this country with a salary of eight hundred riyals. When I arrived, my guarantor said to me, "I do not have an establishment. If you want to work on a percentage basis, fine; otherwise, you can leave." I was forced to stay because my arrival from Egypt cost me more than five thousand riyals. I said I would pay off the debt and then travel. When I wanted to perform Hajj, one of the brothers said to me, "It is not permissible for you to perform Hajj with this money, because your money is forbidden." I asked him why. He said, "Because you agreed to work on a percentage basis and violated the regulations under which you came." Now I want to perform Hajj. I only took that money to pay off my debt, and I have paid it off, praise be to Allah. Is it permissible for me to perform Hajj with that money, or what should I do?

The Shaykh : If you were ignorant and did not know that this work you agreed upon with your guarantor is forbidden, then you owe nothing. This is based on the saying of Allah, Blessed and Exalted is He:
And there is no blame upon you for that in which you have erred but [only for] what your hearts intended وَلَيْسَ عَلَيْكُمْ جُنَاحٌ فِيمَا أَخْطَأْتُمْ بِهِ وَلَكِنْ مَا تَعَمَّدَتْ قُلُوبُكُمْ
[Al-Ahzab 33:5]
. So perform Hajj with this money, and it is lawful for you, because Allah the Exalted said:
So whoever has received an admonition from his Lord and desists may have what is past, and his affair rests with Allah فَمَنْ جَاءَهُ مَوْعِظَةٌ مِنْ رَبِّهِ فَانْتَهَى فَلَهُ مَا سَلَفَ وَأَمْرُهُ إِلَى اللَّهِ
[Al-Baqarah 2:275]
