Monopolizing daughters to marry them to relatives.
Machine translationRead the Arabic original
The Shaykh : Also, what some ignorant people do in monopolizing their daughters for their nephews is prevented from marriage. He monopolizes his daughters to marry them to his nephew. And he states this openly. The girl says: So-and-so proposed to me, a man of religion, good character, wealth, and lineage. The conditions are all present in him. He says: No. You are for your cousin. Glory be to Allah! Who owns the free people after they were free? And if he prevents her from marrying a suitable match and forces her to marry her cousin, then this marriage is a defective marriage, a defective marriage. The woman is not lawful for her husband by it, and her husband has intercourse with her as if she were a forbidden private part, may Allah protect us from that. So this man has enabled his wife to be joined by a man who is not her husband, may Allah protect us from that. And that is because one of the conditions of marriage is the consent of the woman. As the Prophet (peace and blessings be upon him) said: . And he also said: So he specified the virgin, and he specified the father. So how can he marry her to someone she does not want and she is not pleased with? And Glory be to Allah! If a person sold from his daughter's wealth what is worth one dirham without her consent, is his sale valid or not valid? The sale is not valid. Listen, my brother: If a man sold from his daughter's wealth what is worth one dirham without her owning it, then the sale is not valid. So how can he sell the life of this woman without her consent? This is something the Shari'ah does not bring. And therefore I see that these who prevent their daughters from marriage except with their cousins, I see that he is a wrongdoer and that he is an encroacher. And the daughter has the right to take the matter to the court. And we say to this man: Go to the side. You have no guardianship. The scholars say: If a man prevents a woman from marrying a suitable match that she is pleased with, then the guardianship transfers to the one after him. And his guardianship is dropped. They said: And if that is repeated from him, he becomes an open sinner. Do you know the open sinner? The opposite of whom? The opposite of the obedient, the opposite of the just. Meaning, if this man's daughter is proposed to, and men who are suitable in religion and character propose to her, and she is pleased with them. And he says: No. And another proposes to her, and he says: No, and another proposes to her, and he says: No. This man becomes an open sinner who does not take charge of any of the affairs of the Muslims. If he gives permission, his permission is not valid. And if he leads the people in prayer, his leading is not valid. And if he testifies, his testimony is rejected. And if he wants to take charge of someone, he is not enabled to do so. Why? Because he is an open sinner. Even his testimony is not accepted, because Allah says: [Al-Hujurat 49:6], do not accept it, verify it. The matter is serious. And this which I have established now: that the open sinner has no guardianship, no leading, no call to prayer, and no testimony, this is the famous position of the school of Imam Ahmad (may Allah have mercy on him). And there is disagreement in the matter. But I say: The matter is very great. And these wrongdoers who prevent their daughters from marrying suitable matches that the woman is pleased with, these will meet their retribution from Allah on the Day of Resurrection. And some people have related to me about a woman whose father was preventing her. Everyone who came to him to propose to her, he would say: She is young, she is unsuitable, she is already engaged, and the like of that. The woman was afflicted, she was afflicted with an illness, Allah knows best whether it was from the causes of preventing her from marriage or otherwise. The important thing is that she was afflicted. When her death approached, her mother and other women were with her. She said: Inform my father that I did not make him lawful. And he is in a difficult situation from me. And between me and him is the Day of Resurrection. A serious matter. But some people - we ask Allah for well-being - their heart is a stone or harder than stones, selfish, he does not consider the feelings of others, and he does not care about others. And if he marries his daughter, he comes out of the injustice and fulfills the trust. And perhaps children will come from her who will pray for him in life and in death. And how many children of daughters were better than children of sons. So why does he prevent her!
