A man has sons and daughters, and his eldest son has reached the age of eighteen

Machine translationRead the Arabic original
The questioner : He says: A man has sons and daughters, and his eldest son has reached the age of eighteen. He wants to give this son a piece of land so that he can submit it to the real estate bank, in order to save time, since the installment payment requires time. This man intends to give a piece of land to every son who reaches this age. He will compensate the daughters for this. What is your guidance for him—may Allah reward you?

The Shaykh : This is a forbidden act. That is, it is forbidden for him to favor some of his sons with a piece of land over the others, because the Prophet (peace and blessings be upon him) said:
Be afraid of Allah, and be just to your children. اتقوا الله واعدلوا بين أولادكم
Sahih al-Bukhari 2587
. And when Bashir ibn Sa'd wanted the Prophet (peace and blessings be upon him) to witness his giving his son al-Nu'man [a gift], the Messenger (may Allah's prayer and peace be upon him) said:
I bear witness to this other than me, for I do not bear witness to injustice أشهد على هذا غيري فإني لا أشهد على جور
. What prevents him from giving to the young and the old from these lands? What prevents it? And he gives the woman half of what he gives the man. This is the obligation. Even if, for example, he says: "I will ask for their permission." We say: Perhaps they will ask for permission and grant it out of shyness and modesty toward their father, not out of genuine contentment, not out of a willing heart. So it is obligatory for him now to give the remaining male children the same as he gave this son, and to give the females half of what he gives the male. And it ends here.

The questioner : ... .

The Shaykh : Yes? It is ten thirty now, or not? Yes?
