Benefits of the Hadith (When the hide is tanned, it becomes pure).

Machine translationRead the Arabic original
The Shaykh : We will take the benefits, if Allah wills. From the benefits of the hadith of Ibn 'Abbas: that tanning the skin purifies it, based on his saying:
When the skin is tanned it becomes purified. إذا دبغ الإهاب فقد طهر
Sahih Muslim 366a
However, it is a condition in the tanning that it removes the stench and the foul smell; if it does not do so, it has no effect.
And from the benefits of this hadith: that its apparent meaning is that any hide that is tanned becomes pure, even if it is the hide of a dog. However, the stronger position is that this generality is a semantic generality according to the description upon which it came, so it is not restricted to that specific skin, i.e., the skin of that specific sheep. So the generality is of two types: a generality in every species, and a generality in a species restricted by a characteristic. Here, when the hide is tanned, since we know that the cause of that is that the Messenger of Allah (peace and blessings be upon him) passed by a sheep being dragged, it is known that the sheep is from what?
The student: ...

The Shaykh : From what is made lawful by ritual slaughter. So the intended meaning is: when the hide of the species of this sheep is tanned, it becomes pure. If someone asks how you restrict the species or type when the wording is general, we say: its parallel is that the Prophet (peace and blessings be upon him), yes, saw a man who had shaded himself and had a crowd around him, and he was on a journey, so he said: What is this? They said: He is fasting. He said:
It is not an act of righteousness to fast while traveling. ليس من البرّ الصّيام في السّفر
Sunan Ibn Majah 1664Sahih (Darussalam)
Meaning: Fasting on a journey is not from righteousness. So whoever is in a state where the evidence indicates that the Messenger of Allah (peace and blessings be upon him) used to fast on a journey, until Abu al-Darda (may Allah be pleased with him) said: We were with the Prophet (peace and blessings be upon him) in Ramadan on a day of intense heat, and most of us had shade, the owner of the cloak, and some of us shielded the sun with their hands, and none of us was fasting except the Messenger of Allah (peace and blessings be upon him) and 'Abdullah ibn Rawahah. And it is known that the Messenger (peace and blessings be upon him) does not leave righteousness nor do what is not righteousness. And on this basis, it is established that this generality is general in a species of this state. And this does not contradict the saying of the scholars: "The consideration is with the generality of the wording, not the specificity of the cause" because we have not restricted it by the cause now. If we had restricted it by the cause, we would say: Fasting for this man only is not from righteousness. But we generalized it in his species, and this is the meaning of our saying: The consideration is with the generality of the wording, not the specificity of the cause. So on this basis, his saying:
When the hide is tanned إذا دبغ الإهاب
Which hide?
The student: ...

The Shaykh : The hide of this skin, meaning sheep, and sheep are from what is made lawful by ritual slaughter. And from the benefits of the author (may Allah have mercy on him) using the phrase of the four compilers of the Sunan, "any hide," is the indication that the "al" in his saying: "the hide" in the first wording is for generality, so that no one says that "al" is for the known, meaning "your hide." And thus we benefit from this wording what we benefited from at first: that any hide, whether of this type or this species, becomes pure.
And from the benefits of this hadith: the indication that impurity is intended to be removed by any remover. And therefore, the Prophet (peace and blessings be upon him) did not make a tool for purifying the skin of a dead animal other than tanning. If you washed it with sea water, it would not become pure until it is tanned. Why? Answer: Because impurity does not go away except by this. It is known from that that the intended meaning of purification from impurities is their removal by any cause. Branching from this benefit is what exists now of washing clothes with steam. Now there are clothes washed with steam, like wool clothes, for example. If it is washed with steam and the impurity is removed, does it become pure or not?
The student: It becomes pure.

The Shaykh : It becomes pure, and this is based on what the Sunnah indicated, as it is also what reason indicates, since impurity is a foul substance, so whenever it is found, its ruling remains, and whenever it is removed, its ruling is removed.
