The questioner : This is a woman who says: My husband is negligent about praying in congregation, and his prayer at home is not at its proper time, either because he is sleeping or because he is occupied with something useless. I have not left him; I remind him at all times to the extent that disagreement arises between us because of it. He says: “Allah will hold me accountable for that, and you are not the one who holds me accountable.” We have a shower in our house, and I am not pleased with it and do not sit near it. Rather, my husband sits near it, leaves me, and spends his time at the shower. Even for sleep, he sleeps there and does not come to his bed, nor does he give me my right as a wife except occasionally after three months or more, knowing that he is in good health and young?

The Shaykh : I ask Allah (Glorified and Exalted is He) to guide him, to protect him from evil, and to help him with good and obedience. She should ask Allah (Mighty and Majestic) for his guidance and increase in doing so. She is free from his sin as long as she advises him occasionally. If he is guided, it is for him and for her; if he is not guided, it is upon him, except if he abandons prayer entirely. In that case, it is not permissible for her to remain with him for a blink of an eye, because if he abandons prayer entirely, he becomes a disbeliever and an apostate, may Allah protect us from that. A disbeliever apostate is not permitted to have intercourse with a Muslim woman through marriage, because even if he married her with a valid contract before he stopped praying, if he apostatizes and stops praying, it is obligatory to separate them. I am not speaking about the specific person being asked about now, because she did not mention that he does not pray; rather, the apparent state of his affairs is that he prays but is negligent. So we say: Let her strive to ask Allah (Mighty and Majestic) for his guidance. If he is guided, that is what is required. If he is not guided, she bears nothing of his sin. Yes.
