I have often urged him to return to prayer, but he says, "Later, my Lord will guide me." What is the ruling of the Shari'ah in your view regarding remaining with this man? Please inform us, may Allah reward you?
The Shaykh : Praise be to Allah, Lord of the worlds, and I send prayers and peace upon our Prophet Muhammad, the Seal of the Prophets and the Imam of the righteous, and upon his family and all his Companions. The ruling of the Shari'ah in our view regarding staying with this husband who has abandoned prayer, and whom the questioner stated she knows to be a disbeliever for abandoning prayer, is that it is not permissible to remain with this husband whom his wife believes to be a disbeliever, due to the saying of Allah, Blessed and Exalted is He:[Al-Mumtahanah 60:10] Thus, Allah the Exalted clarified in the noble verse that believing women are forbidden to disbelievers, just as disbelievers are forbidden to them. Therefore, she must separate from this husband immediately and not cohabit with him or share a bed with him or anything else, because she is forbidden to him. As for her love for him and her good life with him, if she knows that she is forbidden to him and that he is a stranger to her as long as he persists in abandoning his prayer, then this love will disappear, because for a believer, the love of Allah is above all love, and the Shari'ah of Allah the Exalted is above everything. As for the children, he has no guardianship over them as long as he remains in this state, because one of the conditions of guardianship over children is that the guardian be a Muslim, and this man is not a Muslim. However, I add my voice to the voice of this questioner in advising this man to return to his right mind, return to his religion, abandon his disbelief and apostasy, and perform and establish prayer in the best manner, along with increasing in righteous deeds. If he is sincere with Allah in his intention and resolve, Allah will make the matter easy for him, as He said: .
I advise this man to repent to Allah so that his wife remains with him and his children remain under his guardianship; otherwise, he will have no share in his wife or in the guardianship of his children. Yes.
