The ruling on a man vacating a place for another man, and the Shaykh’s clarification of some of its rulings.

Machine translationRead the Arabic original
The Shaykh : Did you understand? May Allah guide you.

The questioner : Yes, I understood. If there are two parties from the outside, meaning a second and third party, then the lessee... the benefit.

The Shaykh : We, may Allah guide you, did not mention a second or third party. We mentioned a true vacating and a formal vacating. So if you understand this, you will know the answer to this second question.

The questioner : What do you say, O Shaykh, about the sale of benefit?

The Shaykh : The benefit is yours. We told you: it is a rent. The rent is the equivalent of what?

The questioner : The equivalent of a benefit.

The Shaykh : Yes, that is it.

The questioner: Yes.

The Shaykh : No, it seems you did not understand me. You did not understand any of the speech I spoke to you.

The questioner : We understood, may Allah reward you with good. We understood, but we would like to clarify a bit more.

The Shaykh : All right, may Allah reward you with good.

The questioner : Now, this lessee who wants to take the vacating of the place, meaning the vacating as it is called, this is the equivalent of what? He takes it in exchange for the benefit, buying the benefit or selling the benefit. The original rule is that it belongs to the owner, not the lessee, because the benefit is essentially from the location, not from the place itself!

The Shaykh : My brother, may Allah guide you, I have nothing other than what you heard.

The questioner : May Allah reward you with good. This is it; there is no more clarification than this.

The Shaykh: Yes.

The questioner : May Allah reward you with good.

The Shaykh : May Allah preserve you.

The questioner : Thank you, O Shaykh.

The Shaykh: Peace be upon you.

The questioner: And upon you peace.
