Do we declare kufr (disbelief) upon those who circumambulate graves and the like, from among those who manifest acts of kufr?

Machine translationRead the Arabic original
The questioner : Shaykh, regarding the graves, I found here plastered graves, is that not so? There are graveyards here!

The Shaykh : You are pointing here, there are no graves here, the graves you passed by are over there!

The questioner: Yes.

The Shaykh : Yes.

The questioner : Plastered graveyards, have the people of the neighborhood not finished, or rather, do they not know the ruling regarding that?

The Shaykh :
but most of the people do not know." وَلَكِنَّ أَكْثَرَ النَّاسِ لَا يَعْلَمُونَ
[Al-A'raf 7:187]
.

The questioner : I am asking: Did they know about this matter?

The Shaykh : I informed you and spared you the answer:
but most of the people do not know." وَلَكِنَّ أَكْثَرَ النَّاسِ لَا يَعْلَمُونَ
[Al-A'raf 7:187]
.

The questioner : I mean, this is the first time I see plastering!!

The Shaykh : Yes, because you have not left your village to know what exists in other lands.

The questioner : Our Shaykh, it is just the graveyard, nothing with the graveyards!!

The Shaykh : He is not seeing anything, he is not seeing anything, now if you go to Egypt, go to the Mosque of al-Husayn and Sayyidah Zaynab and look at those circumambulating around the graveyards and graves!!

The questioner : Well, speaking of those who circumambulate, Shaykh, the question came: Do we apply the word kufr (disbelief) to them?

The Shaykh: No.

The questioner : I mean, they circumambulate for other than Allah!

The Shaykh : Yes, exactly.

The questioner : And circumambulation is worship!

The Shaykh : And does every one who circumambulates around a grave, or in a broader and more comprehensive phrase, does every one who falls into kufr (disbelief) have kufr (disbelief) attributed to him?

The questioner : The Shaykh : The answer is: No.

The Shaykh : So you have spared us the burden of the answer.

The questioner : But this necessitates that we ask him?

The Shaykh : What do you mean "but"? This is a correction.

The questioner : Without a correction, is it obligatory for us to ask him about his belief regarding this act?

The Shaykh : And what is the fruit of the question, or the lack of the question?! What is the fruit of the question or the lack of the question?

The questioner : The fruit of the question: If we say we do not declare him a disbeliever until we establish the proof against him.

The Shaykh : And the lack of the question?

The questioner : And the lack of the question, the man remains with us in the apparent ruling in the rank of kufr (disbelief).

The Shaykh : In the rank of kufr (disbelief), this is a diplomatic phrase, what does it mean "in the rank of kufr (disbelief)", does it mean he is not a disbeliever?

The questioner: It means he is a disbeliever.

The Shaykh : Here, a disbeliever, I mean.

The questioner: Yes.

The Shaykh : Yes, you have broken what you agreed with me on just now.

The questioner : But we have the apparent ruling, we do not have the hidden ruling.

The Shaykh : Well, there are two contradictory appearances, a man prays to Allah, and prays to the grave, so which of the two appearances do you prioritize over the other?

The questioner : A man prays to Allah!!

The Shaykh: Yes.

The questioner : And a man prays?

The Shaykh : It is the same person.

The questioner : Yes.

The Shaykh : He prays to the grave.

The questioner : To the grave.

The Shaykh : Which of the two appearances do you adopt regarding this person?

The questioner : He prays to the grave for the grave.

The Shaykh : Which of the two appearances do you prioritize over the other, and rule by it regarding the man?

The questioner : The second one.

The Shaykh: Why not the first one?

The questioner: His appearance is that he faces the grave.

The Shaykh : His appearance is that he prays to Allah, and fasts for Allah, and performs Hajj for Allah, and says: There is no god but Allah.

The questioner : But he has broken it!! Is this not a breaker of the covenant?!

The Shaykh : No, we agreed that it is not a breaker of the covenant with certainty, and therefore I said in some of what I said: You want to establish the proof against him, and therefore you ask him, did you forget this speech?

The questioner : No, I did not forget this speech.

The Shaykh : But you neglected it then?
