A person records the lessons of some shaykhs in order to sell them and profit from them, and places on the tapes the notice that the copyright is reserved for him. Is that permissible?

Machine translationRead the Arabic original
The Shaykh : Just a question.

The questioner : Just one question, okay. Our Shaykh, some of the brothers are recording the lessons of knowledge for the other brothers who are students of knowledge.

The Shaykh : What are they doing?

The questioner : Recording the lessons of knowledge, the lessons that are held in the mosques.

The Shaykh : What do they do with them?

The questioner : They record the lessons of knowledge for some of the shaykhs.

The Shaykh : Recording them on tapes?

The questioner: Yes.

The Shaykh: All right.

The questioner : And this man copies these tapes for himself in order to sell them and profit from them, and he places on the tapes the notice that the copyright is reserved for the one who records the tapes. So, is it permissible for him to do this, our Shaykh?

The Shaykh : It is permissible. Why not?

The questioner : So, in this case, it is not permissible for another person to take the tape and copy it without his permission.

The Shaykh : No, it is not permissible. This is his right and his effort. It is not permissible for others to exploit him; because this is an illegitimate selfishness. And as he (peace and blessings be upon him) said:
None of you will have faith till he wishes for his (Muslim) brother what he likes for himself. لا يؤمن أحدكم حتى يحبَّ لأخيه ما يحبُّ لنفسه
Sahih al-Bukhari 13
Let him imagine the situation of this man and how he spends his time and his life.

The questioner : Some mosques are... or, I mean, they establish a library of tapes in the mosque, so that the mosque library provides for itself. The mosque library buys empty tapes and then it records the tapes from other brothers.

The Shaykh : The same question.

The questioner: Yes.

The Shaykh : The same question and the same answer.

The questioner : The same answer in all cases.

The Shaykh: Yes.

The questioner : May Allah reward you with good, O our Shaykh.

The Shaykh : May Allah preserve you.

The questioner: Peace be upon you.

The Shaykh : And upon you be peace and the mercy of Allah and His blessings.
