A quarrel broke out between me and my wife, so I became angry with her in a painful way, hit her in a painful way, and swore at her with divorce.

Machine translationRead the Arabic original
Question: A quarrel broke out between me and my wife, so I became angry with her in a painful way, hit her in a painful way, and swore at her with divorce. However, my wife refused to leave the house, and everything returned to its natural course. Our marital life continued, and after that, she gave birth to three children. Up to this moment, no one has known what happened between me and her except Allah (Glorified and Exalted is He). What must I do now?

Answer: As for what you mentioned regarding your anger toward your wife and hitting her, that is something not to be praised for, and it is not permissible from you. It is obligatory for you, when you become angry, to seek refuge in Allah from the accursed Shaytan, and not to hit your wife or mistreat her to this extent.
As for what you mentioned about your oath of divorce, you have not clarified what you uttered. Do you mean that you swore at her with divorce to prevent her from doing something, or to urge her to do something? This follows the course of an oath, according to the correct opinion of the scholars, so you owe the expiation for an oath. However, if your intention in swearing with divorce was that you effected a divorce upon her, making it immediate, and you divorced her driven by the anger and hitting that occurred from you, and this anger of yours did not cause you to lose your sense, then the divorce takes effect if it was less than three, and you took her back, and the taking back is considered valid.

The result: This requires clarification of what happened from you regarding this divorce. I advise you to contact one of the trusted scholars who issue fatwas, and mention to him what happened from you, and you will find the satisfactory answer, if Allah wills.
