What is the ruling on photographic imaging?

Machine translationRead the Arabic original
The Shaykh : ... there are many images, and very many indeed. In fact, discussing this requires a lecture or more than one lecture. He says, "I hope you will clarify the ruling on photographic imaging?"
... Photographic imaging is also a calamity that has befallen the Muslims ... what they call cameras and imaging devices ... and it is a calamity ... but we must know that everything called imaging is forbidden except out of necessity. The hadiths were mass-transmitted from the Prophet (peace and blessings be upon him) regarding the prohibition of imaging and possessing images, and he was severe in this matter with extreme severity. He said
He who painted pictures in the world would be compelled to breathe soul in them on the Day of Resurrection, but he would not be able to breathe soul (in them).
Sahih Muslim 2110b
... There are many hadiths regarding the prohibition, for I know that you have surely heard many things about it. But the problem is the modern philosophy that is broadcast today through many means, including the radio, the magazine, and the like. The problem today is the approximation between the images that were known in the past ... which were either drawing or carving. Today we have been afflicted with this device, the imaging device. Some scholars have made a distinction between what is imaged by this device and what is imaged by hand. This distinction has no basis, neither in text nor in reason nor in consideration. As for the text, as you heard just now, he says
Whoever makes an image
So-and-so imaged this weed or this image or this room. If so, this is an image and this is an imager. And when the Messenger speaks with a clear Arabic tongue, with precision and with miraculous eloquence, he said, "Whoever images an image," meaning any image, by any device, by any means. And it is strange today ... in the end times a device will appear ... but Allah taught him everything befitting the station of his prophethood. Therefore, I disapprove most strongly ... he says, "What is your knowledge?" as if he had not read the saying of Allah, Blessed and Exalted is He:
(3) Nor does he speak from [his own] inclination. (4) It is not but a revelation revealed,
[An-Najm 53:3-4]
So the answer ... what is his knowledge? He said, peace be upon him: ...
Two categories of people whom I have not yet seen: men with whips in their hands with which they strike people, and women who are clothed yet naked, swaying and causing others to sway, their heads like the sloping humps of camels. May Allah curse them, for they are cursed. They will not enter Paradise and will not smell its scent, though its scent is found from such-and-such a distance.
...
she said, "Who told you this?" He said, "I was informed by the Knowing, the Acquainted."
[At-Tahrim 66:3]
Therefore, this question does not arise ... "Whoever images an image" ... So the following example comes to my mind on this occasion, perhaps it will help you to reach a clear result. I say, by way of ... the topic. They claimed that a noble Shaykh visited a student of his at his home. When he sat ... he reproached him and said to him, "You are a righteous student and a good seeker of knowledge" ...
Angels do not enter a house in which there is a picture
Sahih Muslim 2106e
... He said, "By Allah, O Shaykh" ... The Shaykh returned and visited him a second time, and he found the image again ... "I saw that you took it down, so why did you put it back?" ... This image is like that image. This image is like that image. He said, "May Allah bless you. You are a jurist. Why?" Because the previous image was a hand-drawn image, and the new image is a photographic image ... it was imaged directly by hand or by a device on which its inventor spent many years until he was able to ... its owner spent perhaps days and nights on it. This is what I call a modern appearance, a modern appearance. Because there is a school among the schools of the Muslims ... they have very strange opinions. I will mention one thing. One of them says, regarding his saying, peace be upon him, or in his hadith, peace be upon him, narrated by Abu Hurayrah, he said:
The Messenger, may Allah pray upon him and grant him peace, prohibited urinating in stagnant water.
We have the text of the hadith like this:
It was narrated that: Abu Hurairah said: “The Messenger of Allah forbade Shighar.”
Sunan Ibn Majah 1884Sahih (Darussalam)
"Standing water that is not flowing. The Messenger prohibited urinating in this water" ... So what did this one say? ... He said, "If one urinates in a vessel and then pours what is in the vessel, it is permissible. Why? Because it is not true that he urinated in the stagnant water. O my brother, this is urinating in a vessel, not urinating in stagnant water. Glory be to Allah. Whether he urinated directly in the water or urinated in a vessel and then poured this urine into the stagnant water, the water is polluted and becomes ritually impure ... If the image is hand-drawn, it is forbidden. It is not permissible to image it, and it is not permissible to bring it into the house. The angels flee. But this image, if it is imaged by the photographic device, it is lawful. What is the difference? Only the difference in the means. The first was imaged by hand, and the other by the device ... What changed in the image? As in the hadith, the image is the form. It changed, unlike the one who urinates in stagnant water directly and the one who urinates indirectly. But the goal was achieved. Therefore, the majority of scholars ... the interpretation. The Messenger prohibited urinating in stagnant water because this is what is customary: a person who is not careful comes and says, "This is thick water," and pours the urine ... it is better to preserve this water for those who come after to benefit from it ... urinating in a vessel ... because it is rare ... Therefore, he said, may the prayers and peace of Allah be upon him, "I fear that the following saying will enter into this statement: those who distinguish between the hand-drawn image and the photographic image." He said, may the prayers and peace of Allah be upon him:
May Allah curse the Jews. Fats were forbidden to them, so they rendered them and then sold them and ate their proceeds. And indeed, when Allah forbids something, He forbids its price.
What is the meaning of the hadith ... The Jews, may Allah curse them, for many reasons, including this reason. What is it? The hadith points to some verses of the Qur'an:
For wrongdoing on the part of the Jews, We made unlawful for them [certain] good foods which had been lawful to them
[An-Nisa 4:160]
Good things were made lawful to them, including the fat of livestock. They would slaughter a sheep or a cow, the fat ... because they wronged themselves, Allah punished them by forbidding them some of the good things. So what did the Jews do? They took these fats and put them in the pots and lit the fire underneath them, so they melted and took another form. They sold them and ate them, and ate their prices. What is your argument, O my brother? This is not the natural fat. There was processing, there was a second form. So they deserved the curse of Allah. And in many things ... that the trickery in making lawful what Allah has forbidden is ancient. Let us display this image and this image. Put them together. This is an image ... this in itself. But what is the difference? The means ... There is no disagreement about its prohibition. You image it with your hand or with your device. What is the difference? Therefore, no ... based on the fatwas you hear today on many occasions that photographic imaging is lawful. Rather, it is forbidden. If something is permissible in it, it is also permissible for hand-drawn imaging. And if this thing was permitted in photographic imaging, it is forbidden in hand-drawn imaging, and it is also forbidden. Photographic imaging is forbidden. And this is sufficient, and praise be to Allah, Lord of the worlds.
