The questioner : A man has a group of sons and daughters. He bought a car for each son, intending these cars to be the property of his sons, knowing that their prices vary. The questions here are: Is he required to give the daughters money in place of the cars? And are these cars considered the property of these sons, or do they belong to the heirs? May Allah reward you with good.
The Shaykh : It is established in *al-Bukhari* and *Muslim* that Bashir ibn Sa'd gave a gift to his son Nu'man ibn Bashir; he gave him a garden or a slave, or a garden and a slave. His mother, the mother of Nu'man, said, "I am not satisfied until the Messenger of Allah (peace and blessings be upon him) witnesses this." So Bashir ibn Sa'd went to the Messenger of Allah (peace and blessings be upon him) to have him witness it, and he said to him:. Therefore, it is not permissible to give some of the children a car more expensive than the car given to their brother; rather, the car must be the same car, unless the value of that specific car increases, in which case there is no harm. For example, if he bought a car for the eldest for twenty thousand, and then the one below him needed a car, and he bought him the same type for thirty thousand, then there is no harm in that, because the car is the same car and the value increased, and this was not by his choice. However, if he buys a luxurious car for one of them for fifty thousand and a lesser one for another for twenty thousand, that is forbidden for him. And if he buys cars for the males, he must give the females half of what he gave the males. So if he gives a male, for example, ten thousand, he gives the female five thousand. If someone asks, "How do we give to the females when they do not need cars, unlike the males?" We say, yes, give to them, because he can avoid preferring the males over them while fulfilling the males' need for cars. How? He keeps the cars in his own name and gives them to the children as a loan (ariyah) for their benefit. When the father dies, these cars are returned to the estate and divided among all the heirs. In this way, he is safe from sin, provided he does not prefer one male over another. He buys for them of one type and says, "The car is mine, and you benefit from it for your needs, to fulfill your need." And when the father dies, it returns to the estate. Yes.
