The Shaykh : For this reason, the stronger position among the views of the scholars is that zakah is obligatory on jewelry made of gold and silver. This is because the texts regarding the obligation of zakah on gold and silver are general. When a text is general, its ruling must be established for everything the text covers, unless there is evidence indicating a restriction. There is no evidence regarding jewelry that indicates it should be excluded from the general scope. Therefore, the texts must be kept in their general sense.
Furthermore, there are specific evidences regarding jewelry that indicate the obligation of zakah on it, in addition to the general evidences. If we have general and specific evidences, we will have no argument before Allah on the Day of Resurrection if we withhold zakah by relying on the statements of some scholars. A person is not asked on the Day of Resurrection about what the scholars said, but rather about what the messengers said:
And [mention] the Day He will call them and say, "What did you answer the messengers?" ويوم يناديهم فيقول ماذا أجبتم المرسلين
[Al-Qasas 28:65]
