The questioner : I am asking about a wife who fasts Ramadan but does not pray and excuses herself with household chores and raising the children, knowing that I order her to pray several times and she excuses herself from that. Should I proceed to divorce her?
The Shaykh : If she fasts but does not pray, then inform her that her fasting is invalid, her charity is invalid, her Hajj is invalid, and it is not permissible for her to enter Makkah because she is a disbeliever. And Allah the Exalted said:[At-Tawbah 9:28] And by His saying, Blessed and Exalted is He: [At-Tawbah 9:54] And this false excuse of hers is refuted against her, for prayer does not take up much of her time if she prays as people pray and performs wudu' as people perform wudu'. But this excuse she has made is from the inspiration of Satan and from arguing with falsehood. And if she remains not praying, then she is not lawful for you because she is an apostate disbeliever, and it is not permissible for you to take any benefit from her, and it is obligatory for you to separate from her. She has no custody of her children because a disbeliever has no custody over a Muslim. Therefore, convey to her what I am saying, perhaps Allah will open her heart and she will return to her religion. If she refuses, then there is no good for you in her, and it is not permissible for you to take any benefit from her, as we have mentioned.
The questioner : May Allah reward you with good.
The Shaykh : If she fasts but does not pray, then inform her that her fasting is invalid, her charity is invalid, her Hajj is invalid, and it is not permissible for her to enter Makkah because she is a disbeliever. And Allah the Exalted said:
O you who have believed, indeed the polytheists are unclean, so let them not approach al-Masjid al-Haram after this, their [final] year
And what prevents their expenditures from being accepted from them but that they have disbelieved in Allah and in His Messenger and that they come not to prayer except while they are lazy and that they do not spend except while they are unwilling.
The questioner : May Allah reward you with good.
