How are the hadiths cited by those who hold that reciting al-Fatihah behind the imam in the loud prayers is obligatory to be reconciled?

Machine translationRead the Arabic original
The questioner : A question regarding the description of the Prophet's prayer... concerning the fact that the worshipper recites behind the imam in the silent prayers but does not recite in the loud prayers. In the book "Subul al-Salam", the author presented evidence indicating that the recitation of the Mother of the Book is a condition for the validity of the prayer, and that the prayer is invalid without it. What is the authenticity of these hadiths first, and then how do we reconcile them with your view?

The Shaykh : It is not appropriate, indeed it is impossible, to answer a question like this, because it requires bringing to mind the evidence, some of which is authentic and some is not. The authentic ones have one or more answers. But the questioner who truly wants to benefit by the shortest path is one who studies the description of the prayer and the hadiths reported about it, placing them before him on one side, and then studies what is in Subul al-Salam or other books of hadith jurisprudence. The hadith that causes him difficulty or conflicts with what is in the description of the prayer, he marks it, records it, or writes it on a paper and asks, "What is your opinion of this hadith? Is it authentic first? Yes, it is authentic. Second, does it indicate the obligation of reciting al-Fatihah behind the imam in the loud prayers, or is it not obligatory? It is possible to answer. But it gives us a topic in which the scholars of the Muslims have differed for more than a thousand years, and there is much evidence for both sides. Yes, if I were to memorize the world, I could not answer this question except in hours, let alone us, meaning we ask Allah to include us, what? In His mercy and by His favor, we recall some things and miss others and many things. I give you an example of that from these hadiths that are cited by those who hold to the obligation of reciting al-Fatihah behind the imam in the loud prayers. The hadith
Do not do so except when it is Fatihat al-Kitab, for he who does not recite it is not credited with having prayed. فلا تفعلوا إلا بفاتحة الكتاب فإنه لا صلاة لمن لم يقرأ بفاتحة الكتاب
Sunan Abi Dawud 823Da'if (Al-Albani)
The scholars who follow that school have proceeded to cite this hadith as evidence, and go ahead and walk, but it contains no evidence at all. Why? And this appears naturally, especially to one who has some knowledge of the principles of jurisprudence. The principles of jurisprudence say "If a command for something comes after a prohibition of it, this command does not indicate obligation". If the wise Lawgiver commands something and had previously prohibited it, then this command does not indicate the obligation of that thing, but rather it lifts the prohibition of it. So here the hadith is like this: "Do you recite?" They said, "Yes." He said
Do not do it, do not recite behind the imam. لا تفعلوا لا تقرؤوا وراء الإمام
This is a prohibition. He said
Except with al-Fatihah. إلا بفاتحة الكتاب
This is an exception, an exception from the prohibition. An exception from a prohibition does not indicate obligation, but rather it indicates permissibility. So where is the evidence for obligation? There is no evidence in this hadith for obligation. This is an example. And so the research, as I told you, is long. Look at the hadith, the one like this hadith, for example, it may be one of the hadiths that caused you difficulty. Look at a second hadith, maybe we can give you the answer, or otherwise the Qur'an and the authentic Sunnah agree in this matter
So when the Qur'an is recited, then listen to it and pay attention that you may receive mercy. فإذا قرئ القرأن فاستمعوا له وأنصتوا لعلكم ترحمون
[Al-A'raf 7:204]
and the hadiths that came indicating by their apparent meaning the obligation, they are either of this type that does not indicate obligation, all it indicates is permissibility, and the weaker permissibility, or that it was in a stage of the legislation. And on this we proceeded in our book, The Description of the Prophet's Prayer (peace and blessings be upon him), and this is sufficient, and praise be to Allah, Lord of the worlds.
