The questioner : Is eating the fruits of a tree without the owner's knowledge forbidden, or what is the ruling? Some people say that it is not forbidden because he ate them and did not sell them. What is your opinion on this?

The Shaykh : It is permissible for a person who passes by an orchard containing fruit, with no guard, no netting preventing entry, and no wall, to take from it only as much as fills his mouth. That is, as long as the fruit is on the tree, he may take it even if he becomes full. However, it is not permissible for him to carry anything away with him unless he asks the owner for permission and the owner grants it; that is a different matter.
