Question:
One of the listening sisters says: The sender (G. D. M) says: There is a tree from which we always take miswak, whether it is acacia or not, knowing that this tree does not belong to us, and without the knowledge of its owner. Does this fall under the ruling of theft or lost property, and is it permissible to take from it? May Allah reward you with good.

Answer:
If it is owned by a person, do not take from it except with his permission. As for if it is wild in the desert, there is no harm; praise be to Allah, anyone may take from it. But if it is in the possession of a person, he must be asked for permission to take some of its parts for miswak. If he permits, there is no harm; otherwise, without permission, it is not allowed. Yes.
