The questioner : Praise be to Allah alone, and blessings and peace be upon the one after whom there is no prophet. Allah, Blessed and Exalted is He, said: [Al-Ma'idah 5:2] We thank Allah, Blessed and Exalted is He, for having gathered me withThe Shaykh : Nasir al-Din, may Allah reward him with good. This is the intention of every Salafi in Sudan, to meet you and sit with you. Before we enter the topic of questions, I would like to extend an invitation to you to visit Sudan, so that, if Allah wills, you will come to visit us, and we will all benefit, and the general public will benefit, if Allah wills.
The first question: If I have a commercial establishment and I want to make it a waqf (endowment) for Allah for da'wah and da'iyah (preachers), what is the ruling in the Shari'ah regarding this, knowing that I have family members, but I have no children?
The Shaykh : What appears to me, and Allah knows best, is that there is no objection to the matter, and the case is as he (peace and blessings be upon him) said: If the intention behind this waqf (endowment) is not to deprive the heirs of their rights, then it is a charitable act that is permissible. However, if the intention behind it is to prevent the heir from his right of inheritance, then this becomes an unjust waqf (endowment), like an unjust bequest.
And cooperate in righteousness and piety, but do not cooperate in sin and aggression
