Machine translationRead the Arabic original
The questioner : This is a man from Algeria who also tasked me with this question, and that is that during the French colonial era in Algeria, they killed his son, and his son was twelve years old. When the time of independence came, they registered him as having died a martyr so that they would take the stipend on his behalf, and they began to take this stipend on his behalf through forgery. So he says today that he has repented to Allah the Mighty and Majestic, so what does he do? Meaning, does he acknowledge and confess and return all the amounts they gave him? May Allah reward you with good.

The Shaykh : Who registered him as a martyr?

The questioner : His father.

The Shaykh : His father?

The questioner: Yes.

The Shaykh : He registered him as a martyr, and you are saying that the French killed him.

The questioner : They killed him, yes, and he was twelve years old.

The Shaykh : No problem, so when he registered him, what did he register?

The questioner : He registered that he was older than eighteen years.

The Shaykh : Ah, that is it.

The questioner : So that he would be given the full stipend.

The Shaykh : Yes, exactly.

The questioner : And he has been taking the stipend since independence.

The Shaykh : Okay, if we say that this man is now renouncing the taking of this stipend, what is the consequence for him?

The questioner : That is something Allah knows best.

The Shaykh : Allah knows best, without a doubt, but I in that case cannot say anything but a conditional answer, which is the following: if nothing of harm or damage results for him, or that he is pursued for what they submitted over all these years, then in that case he must renounce it, and that is necessary. Is that clear here?

The questioner: Yes.

The Shaykh : And what he received of these salaries that you referred to, if he is well-off and able to get rid of them by way of giving them, even little by little, to the poor and the needy, then that is what is obligatory upon him. Is that clear?

The questioner: Yes.

The Shaykh : Okay, now you may leave, may Allah guide you.
Abu Layla : May Allah reward you, our Shaykh.

The Shaykh : And beware of yourself.

Another questioner : It is possible to direct it to public facilities.

The Shaykh : Public facilities, with regard to these riba-based monies, which are paving roads, building bridges, or something similar to that.
