The Shaykh Al-Albani’s remarks on neglecting the prayer and the ruling on making it up.

Machine translationRead the Arabic original
The questioner : This is from this...

The Shaykh : This is one, this is two... three, my brother, let him finish first, then...

The questioner : ...

The Shaykh : He (peace and blessings be upon him) said, the answer is what you are hearing now, he (peace and blessings be upon him) said:
Indeed the first deed by which a servant will be called to account on the Day of Resurrection is his Salat. If it is complete, he is successful and saved, but if it is defective, he has failed and lost.
Jami` at-Tirmidhi 413
This is a hadith, another hadith:
And if it is deficient, Allah the Exalted says to His angels: Look, does My servant have any voluntary acts? Then complete for him his obligatory prayer with them.
This is the answer,

The questioner:...

The Shaykh : The deficiency is of two types, the deficiency is of two types, a deficiency in quantity and a deficiency in quality, so whether the deficiency is in quantity or in quality, the completion and making up is from voluntary acts, and therefore the treatment of the error of those who abandon the prayer and repent from abandoning it is not that we order them to worship Allah the Exalted with what has not been prescribed, namely that they pray the prayer outside its time, if Allah says: فويل للمصلين 4 الذين هم عن صلاتهم ساهون So woe to the pray-ers who are heedless of their prayer. You call it making up what is upon you as you claim
Indeed, prayer has been decreed upon the believers a decree of specified times.
[An-Nisa 4:103]
timed with a specific time, a beginning and an end, so they pray the prayer outside its time, so this prayer outside its time, so this prayer outside its time, certainly as you speak, it is not the prayer they neglected certainly.
And if the matter is so, is it permissible for a Muslim who truly believes in Allah and His Messenger, first, and then knows this explicit text, second,
Indeed, prayer has been decreed upon the believers a decree of specified times.
[An-Nisa 4:103]
to come with a prayer in another time wider than the first, wider than what Allah prescribed, Allah prescribed for example the 'Asr prayer between 'Asr and Maghrib, and Maghrib to 'Isha', he is saying to you pray it whenever you want, where did this matter come from
Or have they other deities who have ordained for them a religion to which Allah has not consented?
[Ash-Shuraa 42:21]
the truth and I say the truth, were it not that great imams said about making up, we would have launched a fierce campaign against those who came after them, because those who came after them are not mujtahids, so it is not permissible for them to exercise independent legal reasoning even if they erred except the imams, so if the imams erred they are excused in any case, meaning the issue of making up the prayer is one of the most severe errors that entered Islamic jurisprudence, and the statement about the legitimacy of making up, even though this verse alone is sufficient, so what does the Muslim say about other hadiths in this area.
He (peace and blessings be upon him) said, and this is a hadith known to everyone, the specialists and the general public, but the specialists do not pay attention to it that it invalidates making up, so what do we say about the general public, which is his saying (peace and blessings be upon him):
Whoever catches a rak'ah of the 'Asr prayer before the sun sets has caught it.
As-Sunan al-Kubra lil-Nasa'i 6:219
So the one who did not catch a rak'ah did not catch, what does he do, our scholars, he prays it, okay, why does the Messenger tell you:
Whoever catches a rak'ah
meaning if he did not catch a rak'ah he has no prayer, and if the matter included making up he would not say this (peace and blessings be upon him), because he would complete his prayer even if it came, what? outside its time, in other words, the one who came with the whole prayer outside its time is ordered to do so, and the one who came with part of the prayer in its time and the other part outside its time is not ordered to do this prayer, how is this? It is absolutely unreasonable, but this is the reality, the important thing is that making up has no basis in Islam at all, and the previous hadith I mentioned just now is explicit that the one who missed the prayer is not required to make it up outside its prescribed time, but rather he should increase in the voluntary prayers that have no time, so they are absolute, he increases in them as much as he wants until our Lord the Exalted compensates him from them for what he missed of the obligatory prayers, as we said whether in quantity or quality, if it was deficient Allah the Exalted said to His angels:
Look! Are there any voluntary (prayers) for my worshipper?
Jami` at-Tirmidhi 413
so they complete for him his obligatory prayer with it.

The questioner : ...

The Shaykh : This is also an error because what is expected of the Muslim is the opposite of what is suggested by your words, it is not expected of him that he abandons the prayer, but if something of that happened to him, he makes it up on the Day of Resurrection from the voluntary prayers.

The questioner : It is obligatory upon him...

The Shaykh : No, no, we do not say it is obligatory, where do we get it from, obligation requires a legal proof, but the one who is careful should compensate for what he missed by increasing in voluntary prayers, but we do not say it is obligatory upon him.

The questioner : What is happening now, many people do not pray behind the imam... do we have the right to... when they said the taslim they were not... even though the prayer... is obligatory?

The Shaykh : We have the right to say this, but it is not hidden from you that this is not a proof, this is after relying on the previous proofs we say this, that the disbeliever who becomes a Muslim is not ordered to make up what he did not pray of the prayer. Okay, are you finished?
I give the turn to someone else, the turn is for Abu Yahya.
