Testimony is of two kinds: actual and legal.

The Shaykh : ... that testimony is divided into two categories: actual and legal. If we say regarding these people that they died in the cause of Allah, that is legal testimony, which includes them with those whom the Messenger (peace and blessings be upon him) explicitly mentioned as martyrs, such as one who is killed by a collapsing building, or drowns, or defends his wealth or his self. For these people, it is sufficient that they are ruled to have died in the cause of Allah. As for me, I do not believe that.
