Question:
What is the ruling on concealing testimony, especially if it comes from some of the scholars? Is the one who conceals it considered just and trustworthy, or not? And what criticism (jarh) does the one who conceals it incur?

Answer:
Allah (Exalted and Majestic is He) says:
And do not conceal testimony, for whoever conceals it - his heart is indeed sinfulوَلَا تَكْتُمُوا الشَّهَادَةَ وَمَنْ يَكْتُمْهَا فَإِنَّهُ آثِمٌ قَلْبُهُ
[al-Baqarah:283] If a person has testimony regarding Zayd or 'Amr that he bought something, or sold something, or killed so-and-so, or struck so-and-so, it is not permissible for him to conceal the testimony; rather, it is obligatory for him to make the testimony clear, and it is not permissible to conceal it. As for what concerns his sin before Allah, that is with Allah whether he is excused or not excused; this is up to Allah, and it is obligatory for him to deliver the testimony.
