May Allah preserve you! What is the ruling on a husband testifying to his wife’s admission regarding selling, buying, and agency, and likewise a father testifying to his son, and vice versa?
The scholars say: If a person is accused of being a relative or spouse, his testimony is not accepted regarding the person in whom he is accused, but his testimony is accepted against the person in whom he is accused, and this is correct.Allah the Exalted said: [al-Nisa: 135] .
If a man testifies that his wife did something, and the testimony is against her, then his testimony is accepted without doubt.
But if he testifies in her favor, most scholars say: It is not accepted because he is suspected of bias.
And some scholars said: If he is known for his justice, and we know that he will not give false testimony even for his wife, then his testimony is accepted.And in that case, I say: The judge’s opinion is to be referred to in this matter.
And in summary: As for testimony in favor of a father, a son, or a wife, the original ruling is that it is not accepted.
As for testimony against them, it is accepted.
