The questioner : If Muhammad sells a car to Saleh on monthly installments, and after six months Saleh sees that it is in his interest to sell it, and when he is issued a ruling forbidding it, Muhammad says to him, "I will buy it back from you for such-and-such an amount, which will be deducted from the installments, and such-and-such will remain." Is this permissible?

The Shaykh : This is a buy-back sale ('inah), yes.

The questioner : This is a buy-back sale ('inah).

The Shaykh : This is a buy-back sale ('inah), and it is well known that the buy-back sale ('inah) has two forms. One form is agreed upon by scholars, and it is forbidden; I mean the form agreed upon between the seller and the buyer, and between the buyer and the seller; this is forbidden. As for when it occurs without collusion between the two men, but he knows that the one who is, for example, selling now in ... is in need of money, he should not assist him in that and should not buy from him.
