The Shaykh : I do not say that I directly accuse him of falling short, but I say that if he was not excused in the sight of our Lord (Blessed and Exalted is He), and if he did not apply the rulings of the Shari'ah from the beginning, or rather, before all that, did not call his people, whom he ruled over, to believe in what he believed in, this is before applying the rulings of the Shari'ah, meaning that the rulings of the Shari'ah require the existence of subjects who accept these rulings. If his people were Christians, their status being as it was before they submitted to Allah (Mighty and Majestic) in Islam, then it is not prescribed, nor is it reasonable, near or far, to rule them by Islam while they know nothing about Islam. In fact, the first thing obligatory upon him is to call them to Islam and to clarify to them this Islam in which he believed, before we say that he fell short in leaving the ruling by the judgments of his Lord (Mighty and Majestic). The thing that is completely clear and evident is that he should call them to this Islam in which he believed, as our Messenger (peace and blessings be upon him and his family) indicated in the letter he sent to Heraclius, the King of the Romans, where he said to him:
If you submit, you will be saved, and Allah will give you your reward twice. If you do not do so, then upon you is the sin of the Arisiyyin. أسلم تسلم يؤتك الله أجرك مرتين فإن لم تفعل فإنما عليك إثم الأريسيين
So the Messenger (peace and blessings be upon him) first called him to enter Islam, and then, consequently, to call the Arisiyyin, who are the people and the farmers, to believe in what he believed in, so that he would thereby have two rewards: the reward of his faith and the reward of causing his people to believe in what he believed in. I say that this was the obligation upon the Najashi (may Allah have mercy on him). But I do not say, as stated in the question, that he fell short in not applying the rulings, because the rulings are not currently applicable. However, he may have fallen short in not calling his people to believe in what he believed in. There is no doubt that this is falling short, just as that is falling short. But either he is excused or he is not excused. So the reckoning of each of these and those is with Allah (Mighty and Majestic). Whoever is not excused deserves punishment and torment with Allah (Blessed and Exalted is He), and if he is excused, our Lord (Mighty and Majestic) deals with every person according to what He knows of the truth of his matter. This is my opinion on the subject of the Najashi (may Allah have mercy on him).
