What is your opinion of the statement of some people that those who declared the Ibadis disbelievers did not base that on evidence from the Book or the Sunnah, but rather on the sayings and opinions of men?

Machine translationRead the Arabic original
Al-Halabi : They say that whoever declares the Ibadis disbelievers because they hold to the creation of the Qur'an and the non-seeing of the believers of their Lord on the Day of Resurrection did not rely on the Book or the Sunnah, but rather relied on the sayings and words of men in declaring them disbelievers?

The Shaykh : First, we refute this statement with its opposite. We say that when the Ibadis err against the people of the Sunnah—and we do not say when they declare them disbelievers—they did not rely on the Book or the Sunnah, but rather relied on the sayings of their shaykhs and the shaykhs of narrations that are not connected to them. This is the point of refutation.
Al-Halabi : Yes.

The Shaykh : Second: The Ibadis, or any one of them, should not rejoice in their escape from the declaration of disbelief by some Muslims against them by saying that they did not declare them disbelievers based on verses or hadiths, but rather on the sayings of the shaykhs. One of them should not rejoice, because it is sufficient for them that the one who judged them to be misguided has established the proof against them from the Book of Allah and the hadith of the Messenger of Allah (peace and blessings be upon him). It is not necessary to judge them as disbelievers; it is sufficient for them to be judged as misguided. I personally, and those who came before me and those who agree with me, do not declare a Muslim a disbeliever, no matter how much he deviates in his understanding of the Book of Allah and the hadith of the Messenger of Allah (peace and blessings be upon him), if the proof has not been established against him, or if it has not become clear to him between him and his Lord (Blessed and Exalted is He). We are not judges over the hearts of people; rather, we are guides who clarify to them whether they are on the right path or in clear misguidance.
