Explanation of the Hadith: "The well is a liability, and the mine is a liability."

Machine translationRead the Arabic original
The Shaykh : The Prophet (peace and blessings be upon him) said:
There is no compensation for one killed or wounded by an animal or by falling in a well, or because of working in mines; but Khumus is compulsory on Rikaz. الْعَجْمَاءُ جُبَارٌ، وَالْبِئْرُ جُبَارٌ، وَالْمَعْدَنُ جُبَارٌ، وَفِي الرِّكَازِ الْخُمْسُ

. The point of the hadith—and I do not wish to enter into a full explanation of it, because I feel, and I am sorry, so do not hold me to this, that I am reciting and speaking this hadith, as I believe, in the tongue of the one from whom the hadith originated, namely the Messenger of Allah (peace and blessings be upon him); but the Arabs hardly understand this hadith. What does

mean? I do not want to delve into this, because the research would be very long, and this hadith deserves a lecture of an hour or more. I only want to take one paragraph from it, which is his saying:
And the mine is a liability. وَالْمَعْدَنُ جُبَارٌ
What does "al-ma'dan" (the mine) mean in modern terminology? What they call today is "al-mangam" (the mine), is that not so? A very deep hole dug in a mountain, where workers work in the tens, if not hundreds, on the account of the state. If we assume that a man digs up land and finds it full of precious minerals, and the news reaches the state; according to the socialist system: they confiscate it! But the Messenger says: No, this is the property of its owner. And it is not only that; but if workers come to work in this mine and the mine collapses on the workers, they die on their own account, not on the account of the mine owner. Now the ruling contradicts this in two aspects: first, that it confiscates the mine. Second, that it guarantees—if the state is the owner, or the owner of the mine—it guarantees the rights of those who were injured or killed. Islamic socialism did not look at the limits of the Sunnah, which gathered and contained all the rulings that Muslims need in every time and place. So they imagined that this is a reasonable ruling, and that it achieves what they call today—and perhaps this is one of those names—social justice! Social justice is a beautiful name; but it contains injustice to some individuals, and to some people at the expense of the weak and the poor, or for the benefit of the weak and the poor. But Islam did not leave a law or a system that a human being codifies without finding a solution for it in Islam. So the point is that the name first appeared, and our bodies recoiled from this name: Islamic socialism; then the beads of the rosary turned; and the Islamic bank entered, and the Islamic anthems entered

The questioner : and the Islamic wedding

The Shaykh : and what else?

The questioner : the Islamic wedding

The Shaykh : Many things, and very many, why? Because some people realized that the Islamic world has truly awakened from its heedlessness and its long, deep sleep; so it began to return to Islam gradually. Then the owners of interests realized that there are rulings that contradict the Shari'ah, so they began to justify them and color them; and among that: they call them by a name other than their true name.
