Who determines the mahr, and what are the conditions in the marriage contract?

Machine translationRead the Arabic original
The questioner : And I say, to complete a matter in my mind, perhaps it is the husband who determines the amount of the mahr. Yes, and this is based on what we have seen, where some people are put in an awkward position, and the matter becomes burdensome among people, imposing on oneself what one cannot bear. In reality, Abu 'Abdullah asked me and consulted me on this matter, that the father should offer what is not contrary to the Shari'ah. And from my side, there is a matter in my mind I want to clarify regarding the mahr: it is I who will determine it, not the father, because people may be carried away by passion and customs. Perhaps this good practice we are setting for people will also be recorded. So I determine for myself that the mahr is one hundred Jordanian dinars, and nothing else. And may Allah send prayers and blessings upon our Prophet Muhammad, and upon his family and his Companions.

The Shaykh : The important thing is that you are in agreement with the girl's guardian on this.

The questioner : The girl's guardian, may Allah reward him with good, did not fall short in anything.

The Shaykh : May Allah reward him with good.

The questioner : So he said: We have no conditions, and we have nothing to put down.

The Shaykh : That is the end of the matter.

The questioner : He only stipulated that the house be lawful and that a life be established in it that pleases Allah (Mighty and Majestic), and that it not be as happens in the customs of people, where they leave it to the husband, and then, from the standpoint of false customs and traditions, the disasters that befall the husband, his wife, and his family occur, and he imposes on himself what he cannot bear. So may Allah reward him with good.

The questioner : I ask Allah to bless you in your mahr and your marriage.

The Shaykh : My Shaykh, where is the thing we requested? As we understood from you, may Allah reward you with good, that the guardian does not take anything from the suitor, from the husband. So I said to him: I will not take anything from you. He said: So that we are not put in an awkward position before the gathering, especially before our Shaykh. I said: I want that. I said: You offer what you wish and what pleases you. He said: For the sake of my father. I said: Listen, I care about the matter of your father, because the pleasure of the Lord is in the pleasure of the father. And the two conditions were mentionedThe Shaykh : Abu Malik mentioned one condition and did not mention the second condition, and perhaps he forgot, or as Professor Abu Malik said, from the joy, you deserve it.
The Shaykh : The first condition for me: that the residence be a lawful, independent dwelling with its own food and drink, with our respect and appreciation for your father.
The Shaykh : And the second matter, my Shaykh, from what we learned from you regarding your advice to those who travel to the lands of the West and abandon the Islamic environment and the brothers, meaning who advises them and who are their support in obedience to Allah (Mighty and Majestic), I came to a conclusion, which is: The second condition: that the brother Ahmad does not travel with her outside the country, especially to the lands of Europe, meaning: leaving Jordan, he does not leave with her outside the country, especially to the lands of Europe. And this, my Shaykh, I want to formalize it.

The Shaykh : By way of clarification, I mean: that he does not reside there, not that he travels.

The questioner : That he settles there, so that he is not far from us, and from the brothers and the advice, so that he remains under our eyes.
The Shaykh : My Shaykh, and if there is anything else, my Shaykh, there are things around these two points, there are directives from you, may Allah reward you with good, that are accepted with good acceptance from both parties, by adding a condition we are unaware of, so advise us on it...

The Shaykh : May Allah reward you with good, you left us no room.

The questioner : From you and to you.

The Shaykh : He says the sweet thing is this.

The questioner : I fear now that he will take the advance payment as people are accustomed to, and how is this?

The questioner : Abu Layla : In truth, the brother 'Aziz, I tried him. We concluded the second contract for Abu al-Bara', so the truth is that he is a very, very good judge. He wrote nothing, nothing in every box of the boxes, so this is easy for us.
The Shaykh : My Shaykh, and also our brother 'Aziz is a man of good. The truth is said, he is to be thanked for this, and we have tried other judges, Abu, that he does this action. The truth is said, I say to him: He writes nothing, he does not advance what he delays, he gave... and the details are in the existing boxes. May Allah reward you with good, my Shaykh.
The Shaykh : So my Shaykh, may Allah reward you with all good, to complete as you say, and you taught us: completing a good deed is better than starting it. Now we would like your signature as a witness, you and our Professor Abu Malik, on the contract, so it is not Sufism, my Shaykh, not seeking blessing, truly seeking blessing.
