In my opinion, the one who issues a fatwa permitting taking riba (usury or interest) and giving it to a poor Muslim is permitting the deposit of money in the bank. Because if he said, as every truly Muslim jurist should say, that this person who was afflicted for a period of his life by depositing his money in an interest-based bank, then repented and turned to Allah the Mighty and Majestic, and took the principal and its interest, and gave this interest to a poor person or to the poor, the matter would be easier and less harmful. But I sense from this fatwa the continuation of dealing with the bank in order to benefit the poor with this interest obtained from that money. In that case, this contradicts all the previous texts. And now I must mention a hadith, which is his saying (peace and blessings be upon him):
A dirham of usury that a man consumes is more severe with Allah than thirty-six acts of unlawful sexual intercourse. درهم ربا يأكله الرجل أشد عند الله من ست وثلاثين زنية
, from thirty-six acts of zina (unlawful sexual intercourse)!! So how is it permissible for a Muslim who truly believes in Allah and His Messenger to approve of dealing with riba (usury or interest), but in a way of going around and around? "I am a good man, I do not eat what is forbidden, but I feed what is forbidden!" This is what a Muslim never says. Therefore, the root of the evil must be uprooted fundamentally, and that is by saying to every Muslim: do not deal with interest-based banks. And my saying "interest-based" is not a descriptive attribute, but rather to clarify the reality. I say this for fear that it may occur to some minds that there are non-interest-based banks. No, they are all interest-based. But it may be from the perspective of: "some evil is less than some evil," where one bank, for example, takes five percent, and another takes ten percent. And the first one may not put up the Islamic sign, taking less riba (usury or interest) than the other, while the other may have put up the Islamic sign but eats more riba (usury or interest) than others!!
The Shaykh : In summary: it is not permissible for a specific person to benefit from this riba (usury or interest) if its owner has repented, but if he has not repented, it is not permissible at all. And it is not among the public facilities where it is valid to spend impure money, which is interest-based money, on mosques, because it is certain, without doubt, that every mosque built on money...
