The questioner : There are two men who are partners in a business, one of whom smokes. He takes the cost of cigarettes from the shared capital, which belongs to both partners and is the capital. What is the ruling on this? May Allah reward you.

The Shaykh : It is not permissible for one partner to spend from the shared funds for his own benefit without the consent of his partners, because the money is shared. A person’s exclusive use of shared funds for himself is a betrayal of trust. Allah the Exalted said in the Holy Hadith:
I am the third (partner) of two partners as long as one of them does not cheat the his companion. Then, if he cheats (his partner) I depart from them. أنا ثالث الشريكين ما لم يخُن أحدهما صاحبه، فإذا خان خرجت من بينهما
Bulugh al-Maram 7:124
However, the issue arises if he asks his partner for permission to buy cigarettes from the shared funds for his own smoking. Is it permissible for his partner to give him permission? If he gives him permission, he shares in the sin. If he refuses, that is what is required. He should say to him, “I do not give you permission to buy cigarettes from our shared funds for yourself, because smoking is forbidden due to the religious, worldly, financial, and physical harms that result from it.” Yes.
