Q1: My father passed away and left a sum of money, and we are a group of partners in it. The amount is held by me. Do I have to pay the zakah on it, even without the consent of the other heirs, or should it remain until the money is divided among us?
A1: Zakah is obligatory on the share of each heir in the shared wealth of the heirs if it reaches the nisab or more. It is obligatory for him to pay it out if he is an adult of sound mind. If they appoint one person to pay the zakah on behalf of all of them, there is nothing wrong with that, and the agent acts in their place. If there are minors among them who have not reached puberty and maturity, their guardian acts in their place in paying it out. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
