The questioner : He says:The questioner : My uncle used to not pray or fast, and I want to perform 'Umrah for him. Is that permissible?
The Shaykh : If his uncle does not fast or pray, he is a disbeliever who has apostatized from Islam. It is not permissible to perform 'Umrah for him, nor is it permissible to seek forgiveness for him. However, it is obligatory for him to call his uncle to Islam and to call him to prayer, so that perhaps Allah may guide him through his hand. As for performing 'Umrah for him, how can one perform 'Umrah for a person who is a disbeliever? And Allah the Exalted said:[At-Tawbah 9:113] Therefore, if a person dies while not praying, it is forbidden for his family to bring him to the mosque for Muslims to pray over him. It is obligatory for them to take him out to an open area of land, dig a grave for him, and bury him in it without washing, shrouding, or prayer. This is because the one who does not pray is a disbeliever who has exited the religion of Islam, and may Allah protect us from that. He is like the one who worships an idol and like the one who denies the existence of Allah in that he is a disbeliever, even though disbelief has degrees, some of which are more severe than others.
