The Shaykh : Intentionality: If a person consumes something unintentionally, such as when water enters his stomach while he is rinsing his mouth, he did not intend for the water to enter his stomach, so he owes nothing. The evidence for this is the saying of Allah the Exalted:
And there is no blame upon you for that in which you have erred but [only for] what your hearts intended وليس عليكم جناح فيما أخطأتم به ولكن ما تعمدت قلوبكم
[Al-Ahzab 33:5]
and His saying regarding hunting when a person in the state of ihram kills an animal:
And whoever of you kills it intentionally - the penalty is an equivalent from sacrificial animals to what he killed ومن قتله منكم متعمداً فجزاء مثل ما قتل من النعم
[Al-Ma'idah 5:95]
So, if he killed it unintentionally, he owes nothing. For this reason, if a questioner asked, "I am driving my car, and a pigeon was flying and it collided with the car and died. Do I have to pay its penalty?" The answer is no, because you did not intend it. These are three conditions, and here is a question.
