The questioner : My father (may Allah have mercy on him) passed away three years ago, and we are more than ten heirs, all of whom have reached the age of maturity, both male and female. I would like to know if my eldest brother has a legal right to purchase anything from all our funds, excluding my grandfather’s and grandmother’s shares? They are also among the heirs. For example, if my brother buys a car for the benefit of everyone, given that this purchase is made with the consent of all, and my brother is responsible for managing our funds with our consent and authorization. Does anyone have the right to intervene in this purchase on the grounds that my brother is playing with our money? We naturally reject such intervention. Also, some of the relatives who intervened say that the car must be counted only against my brother’s inheritance. Is this correct, given that we all have an interest in buying this car? We ask for your guidance, may you be rewarded.

The Shaykh : Praise be to Allah, Lord of the worlds, and I send prayers and peace upon our Prophet Muhammad, and upon his family and his Companions, and upon those who follow them with excellence until the Day of Judgment:
What your father left as inheritance is distributed among you according to what Allah (Mighty and Majestic) has prescribed for those with fixed shares, their fixed shares, and the residuary heirs, who are the sons and daughters, receiving what remains, with the male receiving the share of two females. If you are all adults, sane, and of sound mind, the matter is up to you and no one else. If you are confident that your eldest brother will do what he sees as beneficial, no one has the right to object to you.
What I see is that you should not listen to the words of people, for among them are those who follow their desires, some who are hasty and do not deliberate in matters, and some who are malicious and want to divide you and sow enmity between you. As long as your brother has satisfied you and you have seen the goodness of his management, do not pay attention to anyone in any way. The matter of your funds is up to you, and no one has the right to object. If you are adults, sane, and of sound mind, you are free to dispose of your funds as Islamic law requires.
