Q2: My brother passed away, leaving behind a transport truck (a trailer). I sold it. He left behind his wife, his daughter, his mother, and his sister. Do they have a right to this trailer? Please inform us. Also, my brother's daughter has a salary from the insurance fund and receives some charity. I treat her like my own children by buying for her what she needs. Is it permissible for me to take what comes to her?
A2: Your deceased brother's car belongs to his heirs. You must go to the court to determine who inherits from him, identify them, and give them their rights. It is obligatory for you to preserve the money of your brother's daughter that comes from the insurance fund and the charity she needs until she grows up and you hand it over to her in full; because it is the property of an orphan, and it is not permissible to consume it. If she does not need the charity, it is not permissible to take it for her. You may spend on her what she needs from her right. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
