The questioner : He says:The questioner : You know that one of the conditions for obtaining a commercial register is having a balance in one of the banks to obtain a bank guarantee, and we know that depositing money in interest-based banks is forbidden...
The Shaykh : And we know?
The questioner : And we know that depositing money in interest-based banks is forbidden, so what is the ruling if I find someone who gives me the bank guarantee without a balance, or if I place the amount in the bank to obtain the guarantee and then withdraw it before the specified six-month period has passed?
The Shaykh : It is obligatory that transactions be based on truth and clarity, due to the saying of the Prophet (peace and blessings be upon him):Sahih Muslim 1532a If the government does not allow anyone to open a commercial register except with a guarantee that the bank guarantees a specific amount of money, then it is not permissible for a person to resort to a trick in this matter, because the trick involves lying and deceiving the state, and the trick is among the characteristics of the Jews, may Allah protect us from that. Therefore, the Prophet (peace and blessings be upon him) said:
As for the issue of the interest-based bank, there is no doubt that it is obligatory to solve this problem and to establish Islamic banks that deal in accordance with what the Shari'ah requires, so that we are safe from the calamities of these interest-based banks. As for depositing money in them without interest, if there is a dire necessity, there is no harm in that. This is because the banks' transactions are not one hundred percent interest-based; they have other permissible transactions. So if you are compelled to place your money in them without taking riba (usury or interest), then there is no harm in that for the sake of pressing need. However, in this case, choose the bank that is furthest from riba and has the least riba. Yes.
The questioner : May Allah reward you.

Both parties in a business transaction have the right to annul it so long as they have not separated; and if they speak the truth and make everything clear they will be blessed in their transaction; but if they tell a lie and conceal anything the blessing on their transaction will be blotted out.
