The questioner : What is the ruling on one who is in a state of major ritual impurity during the time of the pre-dawn meal, meaning during the time of the pre-dawn meal, then eats the pre-dawn meal, and after the call to prayer intends to abstain, then goes and sleeps while he has not performed the prayer and has not performed the full ritual bath from the major ritual impurity, and sleeps until sunset without performing the prayer and without performing the full ritual bath? Please inform us, may Allah reward you, knowing that his wife attended to his affairs while he was awake and he did not hear her words, so please issue a ruling on this, may you be rewarded?
The Shaykh : If this man abandons the prayer on this day and on other days, then he has no fasting, and his fasting is invalid and rejected, because fasting is not valid from a disbeliever, and one who abandons the prayer is a disbeliever with major shirk that takes him out of the religion, and he is an apostate from Islam. If he dies in this state, he is among the people of the Fire, eternally abiding in it, who will be gathered with Pharaoh, Haman, Qarun, and Abu Jahl.
As for if he abandoned it on that day alone and it is his habit to pray, then there is no doubt that he has committed a great sin, but he does not become a disbeliever because of it, and his fasting is valid, because purity from major ritual impurity is not a condition for fasting. For this reason, if a person becomes in a state of major ritual impurity while he is fasting, his fast is valid. That is, if he becomes in a state of major ritual impurity at the end of the night, then eats the pre-dawn meal and does not perform the full ritual bath until after the dawn breaks, his fasting is valid. The evidence for this is the saying of the Exalted:[Al-Baqarah 2:187] This implies that it is permissible to have intercourse until the dawn breaks, and the necessary consequence of that is that he will not perform the full ritual bath until after the dawn breaks. For this reason, the Prophet (peace and blessings be upon him) would become in a state of major ritual impurity from his wives and then fast.

So now, have relations with them and seek that which Allah has decreed for you. And eat and drink until the white thread of dawn becomes distinct to you from the black thread [of night]. Then complete the fast until the sunset.
