The Shaykh : Then he said:
Except for those who return [repenting] before you apprehend them. And know that Allah is Forgiving and Merciful. إلا الذين تابوا من قبل أن تقدروا عليهم فاعلموا أن الله غفور رحيم
[Al-Ma'idah 5:34]
If they repent before we take action against them, meaning they heard that we were seeking them, so they repented and came to us and threw down their weapons, what is obligatory?
And know that Allah is Forgiving and Merciful. فاعلموا أن الله غفور رحيم

And if we know that, it is obligatory to refrain from them. Good.
Likewise, regarding the remaining hudud (fixed punishments), if a person repents from them before being taken into custody, his repentance is accepted and the hadd is not carried out against him. They mentioned that an Arab bedouin heard a reciter reading the words of Allah the Exalted:
[As for] the thief, the male and the female, amputate their hands in recompense for what they committed as a deterrent [punishment] from Allah وَالسَّارِقُ وَالسَّارِقَةُ فَاقْطَعُوا أَيْدِيَهُمَا جَزَاءً بِمَا كَسَبَا نَكَالًا مِنَ اللَّهِ
[Al-Ma'idah 5:38]
"And Allah is Forgiving and Merciful". The bedouin was amazed, asking how He says "a punishment from Allah" when Allah is the Forgiving, the Merciful? Yes, He does not punish. So the bedouin said to the man, "Repeat it." He said:
[As for] the thief, the male and the female, amputate their hands in recompense for what they committed as a deterrent [punishment] from Allah وَالسَّارِقُ وَالسَّارِقَةُ فَاقْطَعُوا أَيْدِيَهُمَا جَزَاءً بِمَا كَسَبَا نَكَالًا مِنَ اللَّهِ
[Al-Ma'idah 5:38]
"And Allah is Forgiving and Merciful". He said, "What will it become? Repeat it." So the man repeated it and emphasized it, and Allah the Exalted said:
amputate their hands in recompense for what they committed as a deterrent [punishment] from Allah. And Allah is Exalted in Might and Wise. فَاقْطَعُوا أَيْدِيَهُمَا جَزَاءً بِمَا كَسَبَا نَكَالًا مِنَ اللَّهِ وَاللَّهُ عَزِيزٌ حَكِيمٌ
[Al-Ma'idah 5:38]
. He said, "Now I have hit the mark: 'Aziz (Mighty) and Hakim (Wise), so He cut it off. If it had been 'Ghafur (Forgiving) and Rahim (Merciful),' He would not have cut it off."
And this indicates that the names of Allah, Blessed and Exalted is He, necessitate the establishment of the rulings they imply. Hopefully it is clear, if Allah wills. Good.
