The questioner : A woman from Makkah says: My husband eats the pre-dawn meal in Ramadan at approximately 3:00 AM and sleeps until 5:00 PM, then he prays the prayers. Is that called disbelief? And should I stay with him? I ask for your guidance.

The Shaykh : This man is not a disbeliever, but he is a sinner, and his fast is very deficient. This is due to the saying of Allah the Exalted:
O you who have believed, decreed upon you is fasting as it was decreed upon those before you that you may become righteous - يَا أَيُّهَا الَّذِينَ ءامَنُوا كُتِبَ عَلَيْكُمُ الصِّيَامُ كَمَا كُتِبَ عَلَى الَّذِينَ مِنْ قَبْلِكُمْ لَعَلَّكُمْ تَتَّقُونَ
[Al-Baqarah 2:183]
and the saying of the Prophet (peace and blessings be upon him):
Whoever does not give up forged speech and evil actions and does not abandon foolishness, Allah is not in need of his leaving food and drink من لم يدع قول الزور والعمل به والجهل فليس لله حاجة في أن يدع طعامه وشرابه
Bulugh al-Maram 5:14
And what is greater than abandoning the prayer? This man is only similar to one who mocks Allah (Mighty and Majestic). How does he know that Allah has made the prayer obligatory upon him and set it at specific times, where it is not permissible to bring it forward or delay it? And how does he draw near to Allah the Exalted through fasting while he distances himself from Allah by abandoning the prayer? This is a reversal of matters, a reversal of realities. It is obligatory for him to repent to Allah for what he has done and to renew a sincere resolve to perform the prayer in its times with the congregation. And whoever repents, Allah accepts his repentance. Yes.
