The questioner : Our father passed away leaving behind many debts, and he has a group of sons, some of whom are well-off and some are wealthy. Are the wealthy sons required to pay off their father's debts? And are the poor sons exempt? I ask the honorable Shaykh for an answer.
The Shaykh : If a person dies leaving behind debts to people, and he leaves an estate, it is obligatory to pay off the debts from the estate. If he does not leave an estate, it is not obligatory for anyone to pay off his debt on his behalf. However, it is recommended for his wealthy sons, if he has wealthy sons, to pay off his debt, because this is part of being dutiful to parents. If they do not pay off his debt, there is no sin on them, as Allah the Exalted said:[Al-An'am 6:164]. Yes.
The questioner : May Allah reward you. This is a listener, M.A., who says.
